China Leads US in Patent Applications
In 2011 China surpassed the US in patent application filings, according to data compiled by the World Intellectual Property Organization and reported in the Economist.
The State Intellectual Property Office of the People's Republic of China (SIPO) received 526,412 applications in 2011, compared to slightly more than 500,000 at the USPTO and approximately 340,000 at the Japan Patent Office.
In related news, the European Patent Office and SIPO recently announced that Chinese to English machine translation is now available in its Patent Translate service, which is integrated with Espacenet. An additional four million Chinese patent documents are now available in Espacenet.

Cooperative Patent Classification Available
The USPTO and EPO have released the new Cooperative Patent Classification system ahead of the January 1, 2013 implementation date. Details are available at the CPC website. Documentation includes the entire CPC scheme, an initial set of definitions and CPC concordances.

USPTO satellite offices; European patent moves forward
Big patent news from Europe and the US:
The USPTO is planning to open three new satellite offices in Dallas, Denver and Silicon Valley, bringing the total number of regional offices to four. The first USPTO satellite office will open in Detroit on July 13. By coincidence, July 13 is also the 176th anniversary of the first patent issued under the Patent Act of 1836, US 1. In establishing regional offices the USPTO hopes to make it easier for applicants to obtain patents in a timely manner and reduce its backlog of pending applications.
Across the Atlantic, negotiators agreed that the European patent court should be located in Paris with offices in Munich and London. This decision moves Europe one step closer to establishing a single European patent granted by the EPO.

PatentScope Adds EPO Collection
The EPO patent document backfile, which includes bibliographic data from 1978 through mid-2010 and full-text data from 1996 through mid-2010, is now available in PatentScope. With this addition, the WIPO's patent search system has 7.7 million patent documents from 21 regional and national patent offices.
Earlier this year PatentScope added the national patent collections of Colombia, Costa Rica, Guatemala, Panama, Peru and Uruguay. Search interfaces in Korea, Russian and Spanish have also been deployed.

One Classification to Rule Them All?
The USPTO and EPO have agreed to create a new Cooperative Patent Classification (CPC) based on the IPC. You can read the press releases here and here. The new system will be based largely on ECLA, the European version of the IPC, but incorporate the best practices of the U.S. Patent Classification system.
The IPC was created in the 1960s as a common classification system intended to replace the numerous national patent classification systems then in existence. The official treaty creating the IPC system, the Strasbourg Agreement, was signed in 1971. There are now 61 countries party to the agreement. Few national classification systems are still in use. The Canadian Patent Classification system was abandoned in the early 1990s.

New Esp@cenet Improvements
It's October... the time of year when patent searchers wait and watch for news from esp@cenet. The EPO rolled out its latest esp@cenet improvements this week.
The most impressive is a beta search function called SmartSearch. SmartSearch allows the user to enter terms such as inventor name, keyword, publication number, date, etc. in any order and without having to specify a search field for each term. For example, entering "Bombardier CA 2007" will cause SmartSearch to look for Bombardier as the inventor/applicant, Canadian patent documents (2 letters indicating the country code) and 2007 as the publication date.
Clicking on "Refine Search" in a SmartSearch search results list will take you to the SmartSearch search page where you can explore more features. There are 22 search field identifiers, some of them representing more than one field. For example, TA searches both title and abstract. A maximum of 21 search terms can be combined with Boolean operators and a maximum of 4 search terms per search field are allowed. Date range searching and proximity operators are only available at the EP level. Full text searching of the claims and specification is not possible. A maximum of five brackets can be used per search. Left truncation is not permitted.
esp@cenet also has added an export function that exports bibliographic data from up to 30 records at a time from search hit lists and documents stored in the "My Patents List". The fields include title, publication number, publication date, inventor(s), applicant(s), international classification, European classification, application number, date of application, priority number(s) and cited documents. The capacity of the "My Patents List" has been expanded to 100 documents (previously 20).
Esp@cenet also has a new logo celebrating its tenth anniversary.

2008 World Patent Report
The WIPO recently released its 2008 World Patent Report, which contains all kinds of interesting statistics on patent activity worldwide. In 2006, a stunning 1.76 million new applications were filed worldwide, driven largely by filings in China, Korea and the U.S.
One of the most interesting sections covers patent filings per GDP, population and R&D. Both Japan (#1) and Korea (#2) had more than 2000 new resident applications per million population. (Japan 127 million pop. = / Korea pop. = 49 million) The U.S. (#3) managed just shy of 800 resident filings per million (with a pop. of 300 million). In R&D, Korea was the leader again, with slightly more than 5 applications per million $ of R&D funding. Russia, Japan, China and (surprisingly) New Zealand rounded out the top five. The US ranked #7 and Canada #29. Clearly, Asia is keen on generating IP.
All this demand is creating huge problems for patent offices. In 2006, the USPTO had more that one million pending applications, a 30% increase over 2004. Japan has about 800K pending applications, up from 600K in 2004. The EPO, on the other hand, has about 250,000 pending applications, which is about the same as 2004 and 2005. It takes about 40 months on average for the EPO to process an application but only 30 months at the JPO and USPTO. The Korean IP Office processes applications in about 20 months.

Esp@cenet Improvements in 2008
The latest edition (1/2008) of Patent Information News, the European Patent Office's quarterly newsletter on patent information, documentation and searching, is now available.
Page 10 includes a list of esp@cenet improvements planned for 2008. They are:
1. Increase in the number of documents that can be stored in the "My Patents" list.
2. Relaxation in the page limit for PDF documents downloaded from esp@cenet.
3. Full-text searches for patent documents in English, French, and German.
4. Single search field accepting multiple search criteria.
5. Highlighting of search terms.
6. Exportable hit lists.
7. Date range searches.
All of these will be appreciated by patent searchers, but especially the ability to create sophisticated searches in a single search field, export lists and conduct date range searches. The current limit on the size of a document (about 50 pages) that can be downloaded is annoying at times, but since most patents have fewer than 50 pages it doesn't come up often. (At least not in my experience.) For US and WO patents, searchers can use alternate sites such as Patent Lens, pat2pdf and PatentScope to download lengthy patents.
